1. Agreement to Terms

By accessing or using the website and services of PWW Services Inc. ("PWW," "we," "our," or "us"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our website or services. PWW Services Inc. is incorporated under the laws of Alberta, Canada, and operates across Canada.

2. Services

PWW provides property maintenance services including, but not limited to, snow removal, ice management, sanding, sidewalk clearing, lawn care, sod installation, vegetation management, weed control, and industrial site maintenance. All services are subject to availability, weather conditions, and seasonal scheduling.

3. Estimates and Pricing

  • Estimates provided through our website, phone, or in person are non-binding unless confirmed in a signed service agreement or contract.
  • Pricing may vary based on property size, scope of work, accessibility, weather severity, and material costs.
  • Seasonal contracts are billed according to the terms specified in the signed agreement.
  • Per-visit and on-call services are billed at the rates quoted at the time of service.

4. Service Agreements and Contracts

Certain services require a signed service agreement. These agreements outline the specific scope of work, pricing, payment terms, duration, cancellation policy, and liability limitations. In the event of a conflict between these Terms & Conditions and a signed service agreement, the service agreement shall prevail.

5. Payment Terms

  • Invoices are due within thirty (30) days of the invoice date unless otherwise specified in a service agreement.
  • Late payments are subject to interest at a rate of 2% per month (24% per annum) on the outstanding balance.
  • We reserve the right to suspend or discontinue services for accounts with overdue balances.
  • All prices are quoted in Canadian Dollars (CAD) and are subject to applicable taxes (GST).

6. Cancellations and Refunds

  • Seasonal contracts may be cancelled with thirty (30) days' written notice. Fees for services already rendered are non-refundable.
  • One-time or on-call services may be cancelled up to 24 hours before the scheduled service without charge.
  • Weather-related cancellations or delays are at PWW's discretion and do not constitute a breach of contract.

7. Property Access and Conditions

Clients are responsible for ensuring safe and unobstructed access to the service area. PWW is not responsible for damage to unmarked or concealed objects (e.g., garden borders, sprinkler heads, decorative stones, or underground utilities) in the service path. Clients should mark or communicate the location of such items prior to service.

8. Liability and Limitation of Liability

  • PWW carries commercial general liability insurance and workers' compensation coverage as required by Alberta law.
  • We are COR (Certificate of Recognition) certified and comply with Alberta Occupational Health and Safety regulations.
  • Our total liability for any claim arising from services shall not exceed the total fees paid by the client for the specific service giving rise to the claim.
  • PWW is not liable for indirect, incidental, consequential, or punitive damages.
  • We are not liable for delays or service interruptions caused by severe weather events, equipment failure beyond our control, or force majeure events.

9. Bylaw Compliance Services

Services related to municipal bylaw compliance (e.g., local snow-clearing bylaw sidewalk clearing) are performed on a best-effort basis within the timeframes specified. While we strive to meet all compliance windows, PWW is not responsible for fines or penalties issued by the municipality. Clients remain ultimately responsible for ensuring their property meets bylaw requirements.

10. Intellectual Property

All content on this website — including text, graphics, logos, images, and software — is the property of PWW Services Inc. and is protected by Canadian copyright law. You may not reproduce, distribute, or create derivative works from this content without our written consent.

11. Website Use

  • This website is provided "as is" without warranties of any kind.
  • We do not guarantee uninterrupted or error-free access to the website.
  • You agree not to use the website for any unlawful purpose or in a way that could damage, disable, or impair our services.

12. Indemnification

You agree to indemnify and hold PWW Services Inc., its officers, employees, and contractors harmless from any claims, damages, losses, or expenses arising from your use of our services or breach of these Terms.

13. Governing Law

These Terms & Conditions are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts of Alberta.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Changes to These Terms

We reserve the right to update these Terms & Conditions at any time. Changes will be posted on this page with a revised "Last updated" date. Continued use of our services constitutes acceptance of the updated terms.
